Fenix Electric ETX LLC – Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of services provided by Fenix Electric ETX LLC, a Texas limited liability company (“Company”, “We”, “Our”, “Us”) located in Tyler, Texas. By engaging our services, you (“Customer”, “You”, “Your”) agree to these terms.
1. Services Provided
Fenix Electric ETX LLC provides electrical services, including but not limited to, residential and commercial electrical installations, repairs, maintenance, troubleshooting, and consultations (“Services”). Services will be provided based on the agreement reached between the Company and the Customer.
2. Service Estimates and Fees
Estimates: Any estimates provided by the Company are based on the best available information at the time. Estimates are subject to change depending on the scope of work, materials required, and unforeseen circumstances.
Payment: Payment for Services is due upon completion, unless otherwise agreed upon in writing. The Customer will be responsible for all costs associated with the project, including but not limited to labor, materials, permits, and taxes.
Late Payment: If the Customer fails to make payment within the agreed-upon timeframe, the Company may charge late fees, or suspend or terminate services.
3. Customer Responsibilities
Access to Property: The Customer agrees to provide the Company with safe and reasonable access to the work site during business hours, as agreed upon.
Accuracy of Information: The Customer agrees to provide accurate and complete information regarding the work to be performed.
On-Time Payment and Material Repossession: The Customer agrees to provide payment within a sixty day window (60 days) to Fenix Electric ETX LLC. Fenix Electric ETX LLC is a Cash On Demand (COD) company. Failure to provide payment within a sixty day window (60 days) will result in material repossession. Any material(s) that were used are subject to repossession. The Customer agrees to this when The Customer agrees to any service provided by Fenix Electric ETX LLC.
4. Warranty and Guarantee
Workmanship Warranty: Fenix Electric ETX LLC guarantees that all electrical work performed will be done in a professional and workmanlike manner. We provide a limited warranty on our workmanship for a period of 5 years from the date of completion.
Manufacturer Warranties: The Company may provide warranties on materials and products used for the project, but these warranties are governed by the terms provided by the manufacturer.
Exclusions: This warranty does not cover damages or defects resulting from misuse, neglect, improper maintenance, or alterations by the Customer or a third party.
5. Liability
Limitation of Liability: Fenix Electric ETX LLC’s liability for any claims, damages, or loss arising out of the provision of services shall be limited to the amount paid by the Customer for the specific services giving rise to the claim. We will not be liable for indirect, incidental, or consequential damages.
Indemnification: The Customer agrees to indemnify and hold harmless Fenix Electric ETX LLC, its officers, employees, and agents from any claims, losses, or damages arising out of or related to the Customer’s property, including but not limited to accidents, injuries, or damages caused by electrical work performed. In the case of damage to your home, Fenix Electric ETX LLC will rectify the issue with no cost to the customer.
6. Cancellation and Rescheduling
Cancellation by Customer: The Customer may cancel the services provided by the Company at any time before the scheduled service date. Upon acceptance of an estimate, or after a job has begun and any work has been completed, the customer has given implicit permission to be billed for a minimum of the estimated total job cost. When a customer cancels after any work has been performed, Fenix Electric ETX LLC requires the customer to pay for any work that has been performed and 20% of the estimated total job cost as an item that will be noted on their invoice as a “Cancellation Fee.” If the customer has made a deposit, any fee that has been applied to Fenix Electric ETX LLC will be added to this. This is not to penalize the customer, but as a preventative measure to compensate for the cost, effort, reservation of labor, materials, and time that were lost due to the cancellation of a scheduled appointment. All permits are non-refundable. If estimated total job cost is not sufficient to cover the amount owed by the customer, Fenix Electric ETX LLC will collect the amount owed upon request.
Cancellation by Company: Fenix Electric ETX LLC reserves the right to cancel or reschedule services due to unforeseen circumstances, such as inclement weather, safety concerns, availability of necessary personnel or materials, etc.
Cancellation Fee: The cancellation fee is calculated as follows: 20% of Total Estimated Job Cost + Any Applicable Fees (Permits and/or Processing Fees that may be involved). If estimated total job cost is not sufficient to cover the amount owed by the customer, Fenix Electric ETX LLC will collect the amount owed upon request.
7. Confidentiality
Both parties agree to keep all confidential information disclosed during the provision of services confidential and to not disclose such information to any third party, except as required by law.
8. Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve the matter amicably through informal negotiation. If a resolution cannot be reached, the dispute shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. The location of arbitration shall be in Tyler, Texas.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflicts of law principles.
10. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Amendments
Fenix Electric ETX LLC reserves the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to the Company’s website or upon direct notification to the Customer.
